Terms of Service

1. Agreement to Terms

By accessing or using SimpleTuner.io ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

SimpleTuner.io is a cloud GPU training platform that:

• Provides managed GPU compute for machine learning training jobs
• Automatically provisions and manages infrastructure on your behalf
• Provides job monitoring and lifecycle management
• Offers managed dataset storage on Cloudflare R2 for training reuse
• Integrates with SimpleTuner for diffusion model fine-tuning

3. Account Registration

To use the Service, you must:

• Create an account with valid information
• Verify your email address
• Be at least 18 years old or the age of majority in your jurisdiction
• Maintain the security of your account credentials

You are responsible for all activity that occurs under your account.

4. Fees and Payment

The Service uses a prepaid credit system:

• Credits: You purchase credits in advance to fund your training jobs
• Compute fees: Deducted from your credit balance based on actual GPU usage time
• Storage fees: Billed daily for managed datasets at $0.015/GB plus a 30.5% platform fee

Credits are deducted based on the compute time consumed by your training job. You will not be charged for jobs that fail before training begins. You must maintain a sufficient credit balance to submit new jobs.

Storage fees are deducted daily while managed datasets remain stored. We reserve the right to suspend access or delete stored data for non-payment of storage fees.

Failures caused by your configuration or inputs (for example invalid configs or incompatible settings) are billed for the compute time used. Failures caused by our infrastructure are not billed, and you can request reconciliation if you believe we charged you in error.

Payments are processed by Dodo Payments as our Merchant of Record. By using the Service, you also agree to Dodo Payments' terms of service.

5. Retry Policy

Each job allows up to 3 retry attempts. If a job fails, you may retry without creating a new job. You are only charged for the compute time actually used by each attempt, subject to the billing rules above.

6. Promotional Codes

Promotional codes may be offered from time to time:

• Codes may have expiration dates and usage limits
• Codes cannot be combined unless explicitly stated
• We reserve the right to modify or discontinue promotions

7. Acceptable Use

You agree NOT to use the Service to:

• Train models for illegal purposes or to generate illegal content
• Train models that violate third-party intellectual property rights
• Submit training data containing unauthorized copyrighted material
• Abuse, harass, or harm others
• Circumvent security measures or access systems without authorization
• Resell or redistribute the Service without permission
• Submit malicious code or attempt to compromise the Service
• Use managed storage as a general-purpose hosting or public file service

8. Content Moderation

Training Data Requirements: You are solely responsible for ensuring that all training data you submit complies with applicable laws and respects third-party intellectual property rights. You must not submit training data containing unauthorized copyrighted material.

Manual Review Requirement: You must manually review your training data submissions before submitting jobs to ensure compliance with these Terms. Failure to review your submissions may result in job rejection.

Automated Moderation: We employ automated content moderation systems to detect potential policy violations. Jobs flagged by our automated systems will be rejected and will not execute.

Account Suspension: If your account accumulates a significant number of rejected jobs due to policy violations:

• Your account will be immediately suspended
• You will receive immediate notification of the suspension
• Our team will review your account within 72 hours
• You may appeal the suspension by contacting support

Repeated or severe violations may result in permanent account termination.

False Positives: If you believe your authorized training data is being incorrectly flagged by our automated systems, please contact our support team at hello[at]simpletuner.io. We will work with you to review your use case and, where appropriate, adjust our systems to accommodate legitimate workflows.

9. Intellectual Property

You retain all rights to:

• Your training data (that you have lawful rights to use)
• Your training configurations
• Models you create using the Service

We claim no ownership over your content or trained models. However, you represent and warrant that you have all necessary rights to use the training data you submit.

10. Data Handling

Your training data is processed only for the purpose of running your job and providing managed storage when you enable it:

• Data is transferred and staged only during the upload window and job execution
• Managed storage datasets are kept in your Cloudflare R2 bucket until your TTL expires (default 90 days) or you delete them
• Outputs are stored briefly for download after job completion, then deleted
• Data is deleted from compute infrastructure after job completion
• We do not sell, transfer, or use your training data for any purpose other than providing the Service

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service is provided "as is" without warranties of any kind. We may:

• Perform maintenance with or without notice
• Modify or discontinue features
• Suspend accounts that violate these Terms

12. Limitation of Liability

To the maximum extent permitted by law:

• Our liability is limited to the fees you paid in the past 12 months
• We are not liable for indirect, incidental, or consequential damages
• We are not liable for lost data, lost profits, or business interruption

13. Indemnification

You agree to indemnify and hold harmless SimpleTuner.io and its operators from claims arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of third-party rights
• Content you create using the Service
• Training data you submit to the Service

14. Account Termination

You may delete your account at any time. Upon deletion:

• Active jobs will be canceled
• Your personal data will be handled according to our Privacy Policy
• Pending invoices must still be paid

We may terminate accounts that violate these Terms, remain delinquent on payments, or accumulate excessive content moderation violations.

15. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or dashboard notification.

16. Governing Law

These Terms are governed by the laws of the jurisdiction where SimpleTuner.io operates. Disputes will be resolved through binding arbitration or small claims court.
